Tell A Fortune by Daphne/ TERMS OF USE

These Terms of Use (“Terms”) govern the use of Tell A Fortune by Daphne regarding your use of the Service. By accessing or using the Service You agree to the Terms and accept to be bound by them. These Terms affect your legal rights and obligations, so if you do not agree to the Terms, do not use the Service.

Tell A Fortune by Daphne is not able to transfer subscriptions from Apple to Android or vice versa. We are not able to provide any refunds on subscriptions either and this has to be taken up with your ex-provider directly.

1. Rights & Obligations

Service is licensed to you for your personal and non-commercial use only. Your use of the Service might be governed also by separate policies, as provided in connection with such services. Tell A Fortune by Daphne grants to you a limited, non-exclusive, non-sublicensable and non-transferable right to use only the executable version (no source code) of the Service application for your private use. The Service comprises the relevantapplication that enables you to use the Service. You affirm that you have not been previously suspended or removed from the Service. You may not sell or charge others for the right to use Your Account, or otherwise transfer Your Account.

If you download an application for accessing the Service, You may not use such application for any purpose other than the permitted access to the Service. You understand that for reasons that include, without limitation, system security and stability, Service may need to automatically update, pre-load, create new versions or otherwise enhance the application and accordingly, the system requirements to use the applicationmay change over time.

2. iPhone App Subscription

Details of Tell A Fortune by Daphne Subscription:

  1. 1-month subscription is $1.99 (auto-renewed every month) – for one profile
  2. 1-year subscription is $9.99 (auto-renewed every year) – for one profile
  3. A subscription gives you access to premium features and more for one profile.

– Payment will be charged to iTunes Account at confirmation of purchase

– Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period

– The account will be charged for renewal within 24-hours prior to the end of the current period, and the cost of renewal will be the same as your in-app purchase cost.

– Subscriptions may be managed by the user and auto-renewal may be turned off by going to the your account Settings after purchase

3. Intellectual property

The Service (including the related software and media), the design of the Service and associated content including text, scripts, graphics, interactive features and the like, and the trademarks, service marks and logos contained therein (“Tell A Fortune by Daphne
Property”) are owned by or licensed to Tell A Fortune by Daphne, subject to copyright and other intellectual property rights under laws and international conventions. Except asexpressly provided in these Terms, Tell A Fortune by Daphne does not grant any expressor implied rights to use Tell A Fortune by Daphne Property. Tell A Fortune by Daphne may make available to users, for free or upon payment, additional content in the Service,such as videos or pictures or coaching (“Additional Content”). You are hereby granted a limited, nonexclusive, non-sublicensable and non-transferable license to access and usethe Tell A Fortune by Daphne Property and Additional Content only in connection with theusage of the Service. Any use of the Service, Tell A Fortune by Daphne Property or Additional Content other than as specifically authorized in the Terms, is prohibited and will terminate the license to use the same. For the avoidance of doubt, You have no rightto make available to third parties any content originating from the Service.

4. Costs

The Service and any Additional Content shall be available to you upon the payment of the relevant fees stated in connection with the service. By placing your order concerning your use of the Service during the applicable billing period or purchasing any Additional Content, and providing a payment method, You authorize Us to charge you at the applicable fees in accordance with Tell A Fortune by Daphne’s schedule of fees. Save foryour statutory right to cancel your order, payments are non-refundable and there are no refunds or credits for partially used billing periods.

Certain purchases made in connection with the Service are final and non-refundable. In the event that the provision of additional features to the Service and/or material for use in the Service (e.g. any Additional Content that You may download upon separate purchase) is a Service that commences immediately upon acceptance by Astro of your purchase. No refund of any fees shall be available, save for as provided above. Astro has the right to change the price of the Service at any time. Such change will not affect already paid service fees.

5. Security

You shall give to Tell A Fortune by Daphne correct personal and other information necessary for the use the Service. You shall inform Tell A Fortune by Daphne of any changes to such information. Use of your personal and other information is governed by Tell A Fortune by Daphne Privacy Policy, which is incorporated herein by reference. Tell A Fortune by Daphne shall take appropriate online and physical measures to prevent unauthorised access to, improper use of and the reasonable accuracy of your personal data submitted to Tell A Fortune by Daphne via the Service. We use various technologies, including, in certain instances, encryption, to ensure the high security standards. Any data that is stored on Tell A Fortune by Daphne servers is not generally available to the public. However, the use of internet services always includes security risks. You shall be liable for all your own equipment, internet connectivity and software as well as that they do not cause harm to Tell A Fortune by Daphne and/or third parties. You agree to not attempt to damage, hack, crack, reverse engineer, or otherwise interfere with the Service in any manner.

6. Support

Tell A Fortune by Daphne shall have no obligation to provide support or maintenance for the Service under this agreement. Tell A Fortune by Daphne may, at its sole discretion, provide limited technical support for the Service. You understand that the Service is an evolving one. As long as your license for the service is valid you are entitled to upgrades or updates of the service. All upgrades and updates are provided to you on a license exchange basis. You agree that by using an upgrade or update you voluntarily terminate your right to use any previous version. Tell A Fortune by Daphne may license upgrades and updates to you with additional or different terms. You may need to update third partysoftware and/or upgrade your equipment from time to time in order to use the Service.

7. Trademark and Copyright Notice

Certain names, slogans, graphics, logos, service marks, and trade names used on the Service are the trademarks of Tell A Fortune by Daphneand may not be used without permission. Other trademarks, service marks, and trade namesthat may appear on the Service are the property of their respective owners.

8. Disputes & Contact

To Restore in-app Purchases:

If you upgraded or deleted the application, or if you have download problems after purchase, do not worry. Your purchases are guaranteed.It is important to note that Apple, Google and Microsoft doesn’t charge twice for in-app purchases. Since you use the same user of the original purchase.

To restore purchases on iOS platform (iPad, iPhone and iPod Touch)

  • Tap Settings > iTunes & App Stores
  • Tap your Apple ID and password
  • Tap Sign Out
  • Enter your Apple ID (same used to purchase)
  • Open the app and tap Options > Restore Purchases

Cancel subscription via phone:

If you need to cancel a subscription, you can do so from your device’s Settings. Follow the instructions below to cancel the reoccurring subscription from your mobiledevice:

  • Enter your device Settings and scroll to find iTunes & App Store
  • Tap on your Apple ID: [email protected]
  • Tap on View Apple ID
  • Scroll to find Subscriptions
  • Under “Active” subscriptions, tap on Cancel Subscription
  • Continue to Step 2 if a refund is requested.

If you are on iOS version 12.1.4 and later, you can manage your subscription quickly by:

  • Opening the App Store
  • Tap your profile (you should see your photo at the top right corner)
  • Click on ‘Manage Subscriptions’
